JOINT RESOLUTION

Submitting to the qualified voters of Missouri, an amendment to article IV of the Constitution of Missouri, and adopting three new sections relating to the Missouri Veterans' Commission.




Be it resolved by the House of Representatives, the Senate concurring therein:


            That at the next general election to be held in the state of Missouri, on Tuesday next following the first Monday in November, 2008, or at a special election to be called by the governor for that purpose, there is hereby submitted to the qualified voters of this state, for adoption or rejection, the following amendment to article IV of the Constitution of the state of Missouri:

            Section A. Article IV, Constitution of Missouri, is amended by adding three new sections, to be known as sections 48(a), 48(b), and 48(c), to read as follows:

            Section 48(a). There is hereby established within the department of public safety a veterans' commission composed of nine members, five of whom shall be veterans appointed by the governor with the advice and consent of the senate, two members of the house of representatives, one from the majority party and one from the minority party, appointed by the speaker of the house of representatives, and two members of the senate, one from the majority party and one from the minority party, appointed by the president pro tem of the senate. Members appointed from the general assembly shall serve a single two-year term. Terms of office and duties of the commission shall be as provided by law.

            Section 48(b). For the purpose of providing additional moneys to be expended and used by the Missouri veterans' commission established by section 48(a) of this article, for aid and assistance to veterans as provided by law, an additional sales tax of one-eighth of one percent is hereby levied and imposed upon all sellers for the privilege of selling tangible personal property or rendering taxable services at retail in this state upon the sales and services which now are or hereafter are listed and set forth in, and, except as to the amount of tax, subject to the provisions of and to be collected as provided in the "Sales Tax Law" and subject to the rules and regulations promulgated in connection therewith; and an additional use tax of one-eighth of one percent is levied and imposed for the privilege of storing, using, or consuming within this state any article of tangible personal property as set forth and provided in the "Compensating Use Tax Law" and, except as to the amount of tax, subject to the provisions of and to be collected as provided in the "Compensating Use Tax Law" and subject to the rules and regulations promulgated in connection therewith. The provisions of this section shall be self-enforcing except that the general assembly shall adjust brackets for the collection of the sales and use taxes. The additional revenue provided by this section shall not be part of the "total state revenue" within the meaning of sections 17 and 18 of article X. The expenditure of this additional revenue shall not be an "expense of state government" under section 20 of article X. The effective date of this section shall be January 1, 2009, and shall terminate December 31, 2016, unless reauthorized by the voters in a proposal to be submitted on Tuesday next following the first Monday in November, 2016, and every ten years thereafter. For any reauthorization proposal so submitted, the secretary of state shall propose the reduction of the applicable sales and use tax rates from one-eighth of one percent to one-tenth of one percent.

            Section 48(c). All monies arising from the additional sales and use taxes provided for in Section 48(b) hereof shall be deposited in the Missouri Veterans' Commission Sales Tax Fund which is hereby established within the state treasury and shall be expended pursuant to appropriation by the general assembly and used by the Missouri veterans' commission for the purposes set forth in Section 48(b), and for no other purpose.
