FIRST REGULAR SESSION
HOUSE COMMITTEE SUBSTITUTE FOR
95TH GENERAL ASSEMBLY
1529L.04C D. ADAM CRUMBLISS, Chief Clerk
AN ACT
To amend chapter 163, RSMo, by adding thereto one new section relating to school funding, with an emergency clause.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 163, RSMo, is amended by adding thereto one new section, to be known as section 163.095, to read as follows:
163.095. 1. For any district in the county with a charter form of government and with more than one million inhabitants that in calendar year 2005 (school year 2005-2006) erroneously set a levy in the capital projects fund rather than the incidental fund and reported the capital projects amount to the county for which the county issued tax notices and the district received taxes for calendar year 2005, the department of elementary and secondary education shall calculate the amount the district would have received in state school aid for fiscal year 2006 had the district placed the levy in the incidental fund rather than the capital projects fund and use this revised 2005-2006 calculated funding amount in the distribution of state school aid for fiscal year 2010 and subsequent years. The calculation shall not change the actual funding due the district for the 2005-2006 school year.
2. After the completion of the 2010-2011 fiscal year, the state auditor shall perform a follow-up audit for the school district described in subsection 1 of this section to determine to what extent the issues addressed in the district's 2007 audit have been addressed.
3. The school district shall obtain an independent appraisal prior to selling property.
Section B. Because immediate action is necessary to synchronize the requirements of section A of this act with the school calendar and state fiscal year, section A of this act is deemed necessary for the immediate preservation of the public health, welfare, peace, and safety, and is hereby declared to be an emergency act within the meaning of the constitution, and section A of this act shall be in full force and effect upon its passage and approval.
