AN ACT
To amend chapter 191, RSMo, by adding thereto one new section relating to the Alzheimer's state plan task force.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 191, RSMo, is amended by adding thereto one new section, to be known as section 191.990, to read as follows:
191.990. 1. There is hereby established the "Alzheimer's State Plan Task Force" within the department of health and senior services. The task force shall consist of the following nineteen members:
(1) The lieutenant governor, or the lieutenant governor's designee;
(2) The directors of the departments of health and senior services, social services, and mental health, or the directors' designees;
(3) One member of the house of representatives to be appointed by the speaker of the house;
(4) One member of the senate to be appointed by the president pro tem of the senate; and
(5) The following thirteen members to be appointed by the governor:
(a) One person who has early state Alzheimer's disease or related dementia;
(b) One person who is a family caregiver of a person with Alzheimer's disease or related dementia;
(c) One licensed physician who has experience in the diagnosis, treatment, and research of Alzheimer's disease;
(d) One person from the office of the state ombudsman for long-term care facility residents;
(e) One person representing the home care profession;
(f) One person representing residential long-term care;
(g) One person representing the adult day services profession;
(h) One person representing the insurance industry;
(i) One person representing area agencies on aging;
(j) One licensed attorney with expertise in elder law;
(k) One person with expertise in minority health; and
(l) Two persons representing the Alzheimer's Association.
2. Members of the task force shall serve without compensation but may be reimbursed for their actual and necessary expenses from moneys appropriated to the department for that purpose. The department shall provide technical and administrative support services as required by the task force.
3. The task force shall have the following duties:
(1) To assess the current and future impact of Alzheimer's disease and related dementia on residents of the state of Missouri;
(2) To examine the existing services and resources addressing the needs of persons with dementia, their families, and caregivers; and
(3) To develop recommendations to respond to the escalating Alzheimer's disease and related dementia public health situation.
4. The task force shall include an examination of the following in its assessment and recommendations:
(1) Trends in state Alzheimer's disease and related dementia populations and their needs, including but not limited to the state's role in long-term care, family caregiver support, and assistance to persons with early-stage Alzheimer's disease, early onset of Alzheimer's disease, and individuals with Alzheimer's disease and Down's Syndrome;
(2) Existing services, resources, and capacity, including but not limited to:
(a) The type, cost, and availability of services for persons with dementia, including home and community-based resources, respite care to assist families, residential long-term care options, and adequacy and appropriateness of geriatric-psychiatric units for persons with behavioral disorders associated with Alzheimer's disease and related dementia;
(b) Dementia-specific training requirements for individuals employed to provide care for persons with dementia;
(c) Quality care measures for services delivered across the care continuum;
(d) The capacity of public safety and law enforcement personnel to respond to persons with Alzheimer's disease and related dementia; and
(e) State support for Alzheimer's disease research through institutes of higher education in this state;
(3) Needed state policies or responses, including but not limited to directions for the provision of clear and coordinated services and supports to persons and families living with Alzheimer's disease and related dementia, and strategies to address any identified gaps in services.
5. The task force shall gather public input, including but not limited to:
(1) The holding of at least one meeting in four diverse geographic regions of the state during the calendar year; and
(2) Coordinating a statewide survey to gather input on services, supports, and unmet needs from persons and families affected by Alzheimer's disease and related dementia.
6. The task force shall submit a report of its findings and date-specific recommendations to the governor and general assembly in the form of a state Alzheimer's plan no later than November 1, 2010.
7. The task force shall continue to meet at the request of the chair and at a minimum of one time annually for the purpose of evaluating the implementation and impact of the task force recommendations and to provide annual supplemental reports on the findings to the governor and general assembly.
