AN ACT

To amend chapter 104, RSMo, by adding thereto three new sections relating to Missouri retirement systems.

Be it enacted by the General Assembly of the state of Missouri, as follows:

            Section A. Chapter 104, RSMo, is amended by adding thereto three new sections, to be known as sections 104.165, 104.555, and 104.1007, to read as follows:

            104.165. Notwithstanding the definition of compensation in section 104.010, any amounts paid after June 30, 2010, as overtime or compensatory time on the state payroll system to members of the Missouri department of transportation and highway patrol employees' retirement system shall not be included in any calculation of average compensation in the closed plan for purposes of any annuity or benefit paid by the Missouri department of transportation and highway patrol employees' retirement system under the closed plan.

            104.555. Notwithstanding the definition of compensation in section 104.010, any amounts paid after June 30, 2010, as overtime or compensatory time on the state payroll system to members of the Missouri state employees' retirement system shall not be included in any calculation of average compensation in the closed plan for purposes of any annuity or benefit paid by the Missouri state employees' retirement system under the closed plan.

            104.1007. Notwithstanding the definition of pay in section 104.1003, any amounts paid after June 30, 2010, as overtime or compensatory time on the state payroll system to members of the Missouri department of transportation and highway patrol employees' retirement system or the Missouri state employees' retirement system shall not be included in any calculation of final average pay in the year 2000 plan for purposes of any annuity or benefit paid by the Missouri department of transportation and highway patrol employees' retirement system or the Missouri state employees' retirement system under the year 2000 plan.
