AN ACT

To amend chapter 262, RSMo, by adding thereto one new section relating to agricultural advertising.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 262, RSMo, is amended by adding thereto one new section, to be known as section 262.005, to read as follows:

            262.005. 1. Notwithstanding any other provision of law to the contrary, any agri-tourism business shall have the right to place advertising signage along the roads and highways of this state on either:

            (1) Private property by or near a road or highway with the consent of the owner of the private property; or

            (2) Within the right-of-way of a road or highway with the approval of the Missouri department of transportation.

            2. For purposes of this section, "agri-tourism business" means:

            (1) An established agri-tourism attraction whose products or services are regulated by the department of agriculture; or

            (2) Any activity, enterprise, or business which attracts or is used by more than ten thousand visitors annually which provides an experience of visiting a working farm or any agricultural or horticultural operations for the purpose of enjoyment, education, or active involvement in the activities of the farm or operation. Such activities, enterprises, or businesses include but are not limited to agricultural-related museums, agriculture-related festivals and fairs, corn maze enterprises, farmers markets, on-farm tours, on-farm retail markets, on-farm vacations, on-farm festivals and fairs, on-farm petting zoos, on-farm fee-fishing, on-farm horseback riding, on-farm bed and breakfasts, pick-your-own farms, and wineries.
