AN ACT
To amend chapter 392, RSMo, by adding thereto one new section relating to caller location in emergency situations.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 392, RSMo, is amended by adding thereto one new section, to be known as section 392.415, to read as follows:
392.415. 1. A telecommunications company shall provide call location information concerning the user of a telecommunications service, including a wireless telecommunications service, in an emergency situation to:
(1) A public safety answering point as defined in section 190.400, RSMo, emergency medical service provider or emergency dispatch provider, public safety, fire service, law enforcement official, or hospital emergency or trauma care facility in order to respond to the user's call for emergency services; or
(2) Providers of information or database management services solely for purposes of assisting in the delivery of emergency services in response to an emergency.
2. As used in this section, "emergency situation" means any situation in which a user of telecommunications service reasonably believes that a crime is about to be committed, is being committed, or has been committed involving injury or a threat of injury to any person.
