AN ACT

To amend chapter 304, RSMo, by adding thereto one new section relating to the use of electronic wireless communications devices while driving.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 304, RSMo, is amended by adding thereto one new section, to be known as section 304.850, to read as follows:

            304.850. 1. As used in this section, the term "electronic wireless communications device" includes any cellular phone, palm pilot, blackberry, or other mobile electronic device used to communicate verbally or by text or by electronic messaging, but shall not include any built-in navigational or emergency road service assistance system.

            2. Upon a conviction or a plea of guilty by any person for a moving violation as defined in section 302.010, RSMo, or any offense listed in section 302.302, RSMo, the court shall double the amount of fine authorized to be imposed by law, if the moving violation or offense occurred while the driver of the vehicle was using an electronic wireless communications device.

            3. This section shall not be construed to enhance the assessment of court costs or the assessment of points under section 302.302, RSMo.
