AN ACT

To amend chapter 217, RSMo, by adding thereto one new section relating to the shock time for felony probationers program, with a penalty provision.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 217, RSMo, is amended by adding thereto one new section, to be known as section 217.363, to read as follows:

            217.363. 1. The department of corrections shall establish by regulation the "Shock Time For Felony Probationers Program". The purpose of this program is to give the court an alternative to the imposition of a sentence for those nonviolent felony offenders who are in violation of the terms of their probation in cases where no sentence has been imposed.

            2. To be eligible for this program the offender must have committed a nonviolent felony offense and be in violation of the terms of his or her probation in a case where no sentence has been imposed.

            3. Offenders committed to the program would serve a shock detention of no less than ninety days and no more than one hundred twenty days in the department of corrections. This commitment to the department of corrections would serve as an alternative to the imposition of a conventional sentence to the department of corrections by the court.
