AN ACT

To repeal section 517.021, RSMo, and to enact in lieu thereof one new section relating to the rules of civil procedure.

Be it enacted by the General Assembly of the state of Missouri, as follows:

            Section A. Section 517.021, RSMo, is repealed and one new section enacted in lieu thereof, to be known as section 517.021, to read as follows:

            517.021. 1. The rules of civil procedure shall apply to cases or classes of cases to which this chapter is applicable[, except where otherwise provided by law].

            2. In any case subject to this chapter where the defendant is not represented by counsel, the formal rules of discovery as set forth in Rule 56 to Rule 61 of the Missouri rules of civil procedure shall not apply except for good cause shown and upon order of the court.

            3. In the event the defendant retains counsel who enters his or her appearance in any case subject to this chapter, the formal rules of discovery shall apply.
