AN ACT
To amend chapter 163, RSMo, by adding thereto one new section relating to school funding.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 163, RSMo, is amended by adding thereto one new section, to be known as section 163.410, to read as follows:
163.410. 1. In any fiscal year in which the school funding formula basic apportionment under section 163.031 is not fully funded because the amount appropriated for the purpose is insufficient to meet the amount required by statute, school districts shall be excused from compliance with the following statutes in that fiscal year:
(1) Spending funds for professional development under section 160.530, RSMo;
(2) The minimum summer school enrollment to avoid the penalty imposed by subdivision (7) of subsection 4 of section 163.031; and
(3) Minimum teacher salary required for the year under section 163.172.
2. If the governor withholds funds for the school funding formula basic apportionment under section 163.031, school districts shall be excused from compliance with the statutes listed in subdivisions (1) to (3) of subsection 1 of this section in the following fiscal year.
3. In any fiscal year in which the transportation categorical funding results in less than a sixty percent reimbursement rate, school districts may operate on a four-day school week with a minimum of one thousand forty-four hours of classroom time. The one hundred seventy-four day requirement of section 171.031, RSMo, shall not be required in any such year.
