AN ACT

To amend chapter 379, RSMo, by adding thereto one new section relating to automobile insurance.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 379, RSMo, is amended by adding thereto one new section, to be known as section 379.805, to read as follows:

            379.805. 1. No insurer shall refuse to issue automobile liability insurance to an applicant solely because such applicant is a volunteer driver. No insurer shall impose a surcharge or otherwise increase the rate for automobile liability insurance coverage solely on the basis that the named insured, a member of the insured's household, or a person who customarily operates the insured motor vehicle is a volunteer driver.

            2. For purposes of this section, "volunteer driver" means a person who provides services, including transporting individuals or goods, without compensation in excess of expenses to a nonprofit charitable organization.

            3. The provisions of this section shall not prohibit an insurer from refusing to renew, imposing a surcharge or otherwise increasing the rate for automobile liability insurance coverage based on factors other than the volunteer status of the insured driver.
