AN ACT

To amend chapter 429, RSMo, by adding thereto one new section relating to construction liens.

Be it enacted by the General Assembly of the state of Missouri, as follows:

            Section A. Chapter 429, RSMo, is amended by adding thereto one new section, to be known as section 429.011, to read as follows:

            429.011. 1. On all residential construction projects any contractor who works on the construction project and who subsequently contracts with other contractors for the completion of the construction project shall provide the homeowner with written notice that a lien may be placed on the house if such contractor fails to pay for the materials of the subcontractor or other contractor with whom they contracted. The contractor shall also provide a form for the homeowner to sign acknowledging that the homeowner has received the notice required by this section.

            2. The contractor shall then provide a copy of the signed notice acknowledgment form to any business entity extending credit to the contractor.

            3. Any business entity who receives a copy of a signed notice acknowledgment form from a contractor shall keep such form on file.

            4. Any business entity or contractor who attempts to enforce such a lien shall produce a copy of the signed notice acknowledgment form.
