JOINT RESOLUTION

Submitting to the qualified voters of Missouri, an amendment to article IV of the Constitution of Missouri relating to the distribution of highway funds.




Be it resolved by the House of Representatives, the Senate concurring therein:


            That at the next general election to be held in the state of Missouri, on Tuesday next following the first Monday in November, 2010, or at a special election to be called by the governor for that purpose, there is hereby submitted to the qualified voters of this state, for adoption or rejection, the following amendment to article IV of the Constitution of the state of Missouri:

            Section A. Article IV, Constitution of Missouri, is amended by adding thereto one new section, to be known as section 30(f), to read as follows:

            Section 30(f). 1. Beginning July 1, 2011, ten percent of the amount of net general revenue growth occurring between fiscal year 2010 and fiscal year 2011 shall be transferred to the state road fund and the state transportation fund, with the state road fund receiving ninety-five percent of such amount and the state transportation fund receiving five percent of such amount. Any amount transferred to the state road fund shall stand appropriated without legislative action.

            2. Beginning July 1, 2012, and the beginning of each fiscal year thereafter, the state treasurer shall determine the amount to be transferred to the credit of the state road fund and the state transportation fund in each fiscal year by computing the amount of net general revenue collected in the prior fiscal year and comparing such amount to the amount of net general revenue collected in the 2010 fiscal year. After determining the amount of net general revenue growth, an amount equal to ten percent of the increase computed under this section shall be transferred by the state treasurer to the credit of the state road fund and the state transportation fund, with the state road fund receiving ninety-five percent of such amount and the state transportation fund receiving five percent of such amount.

            3. The moneys apportioned or distributed under this section to the state road fund and the state transportation fund shall not be included within the definition of "total state revenues" as that term is used in section 17 of article X of this constitution nor be considered as an "expense of state government" as that term is used in section 20 of article X of this constitution.
