To amend chapter 194, RSMo, by adding thereto one new section relating to anatomical gifts.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 194, RSMo, is amended by adding thereto one new section, to be known as section 194.310, to read as follows:
194.310. 1. This section shall be known and may be cited as the "William John Yates Law".
2. Nothing in sections 194.210 to 194.307 shall be construed as prohibiting or otherwise restricting any person who is or has been incarcerated in this state or any other state from being a voluntary donor of an anatomical gift in accordance with sections 194.210 to 194.307.
3. An anatomical gift donation by a person who is or has been incarcerated shall be deemed involuntary if such donation is obtained through coercion or undue influence, or an incentive is offered in exchange for such donation, including but not limited to a reduced sentence or early release for good behavior based on such donation.
