AN ACT

To amend chapter 163, RSMo, by adding thereto one new section relating to school funding, with an emergency clause.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 163, RSMo, is amended by adding thereto one new section, to be known as section 163.039, to read as follows:

            163.039. 1. Pursuant to the qualifications and calculations established in section 163.031, in any year in which the appropriation levels are less than the amount necessary to fund the sum total of the entitlement calculation, the department of elementary and secondary education shall calculate and distribute to each school district qualified to receive state aid an amount determined by dividing the district's state aid payment from the preceding year by the district's weighted average daily attendance from the previous year, and multiplying the quotient by the district's current-year weighted average daily attendance.

            2. If the appropriation level is less than the amount necessary to fund the sum total of the entire calculation for all districts under subsection 1 of this section, the department of elementary and secondary education shall determine the percentage by which the appropriation level is below what is necessary to fund the sum total of the entitlement calculation and shall decrease the funding level for every district in the state by that percentage.

            3. If the appropriation level is greater than the amount necessary to fund the sum total of the entire calculation for all districts under subsection 1 of this section, the department of elementary and secondary education shall determine the percentage by which the appropriation level exceeds what is necessary to fund the sum total of the entitlement calculation and shall increase the funding level for every district in the state by that percentage.

            4. The provisions of this section shall sunset effective June 30, 2015.

            Section B. Because immediate action is necessary to provide sufficient guidance on the allocation of appropriate funds, this act is deemed necessary for the immediate preservation of the public health, welfare, peace, and safety, and is hereby declared to be an emergency act within the meaning of the constitution, and this act shall be in full force and effect on July 1, 2012, or upon its passage and approval, whichever occurs later.
