AN ACT
To repeal section 162.014, RSMo, and to enact in lieu thereof one new section relating to school board members, with a penalty provision.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Section 162.014, RSMo, is repealed and one new section enacted in lieu thereof, to be known as section 162.014, to read as follows:
162.014. 1. No person shall be a candidate for a member or director of the school board in any school district in this state if such person:
(1) Has a substantiated report of child abuse or neglect on the child abuse and neglect registry under section 210.152; or
(2) Is registered or is required to be registered as a sex offender under sections 589.400 to 589.425.
2. (1) Any candidate for a member or director of the school board shall file an affidavit attesting that such candidate does not have a substantiated report of child abuse or neglect on the child abuse and neglect registry under section 210.152 and is not registered or required to be registered as a sex offender under sections 589.400 to 589.425.
(2) Any person who makes a false affidavit of qualification under this section is guilty of a class one election offense under section 115.631.
3. Any member or director of the school board of any school district who has a substantiated report of child abuse or neglect on the child abuse and neglect registry under section 210.152 or is registered or required to be registered as a sex offender under sections 589.400 to 589.425 shall be ineligible to serve as a member or director of a school board of any school district at the conclusion of his or her term of office.
