HB 768 -- Choice of Law

Sponsor:  Bahr

This bill specifies that any court, arbitrator, administrative
agency, or other adjudicative, mediation, or enforcement
authority must not enforce a foreign law if it would violate a
right guaranteed under the Missouri Constitution or the United
States Constitution.  If a contractual provision or agreement
provides for the choice of law to govern any dispute and it
violates the public policy of Missouri, the contractual provision
or agreement must be modified to the extent necessary to preserve
the constitutional rights of the parties.  If the contractual
provision or agreement is incapable of being modified, it will be
null and void.
