INTRODUCED

HB 70 -- Power of Attorney

Sponsor:  Boucher

This bill allows a principal to authorize his or her attorney to
declare the principal incompetent.  Further, the bill creates a
rebuttable presumption of incompetency when such an attorney
declares the principal incompetent.  Current law contains no
such presumption, and requires proof by clear and convincing
evidence that a person is incapacitated before the court may
appoint a guardian for that person.
