AN ACT

Requiring certain equipment on school buses.






Be it enacted by the General Assembly of the state of Missouri, as follows:

Section 1. 1. After January 1, 2001, any new school bus purchased by any school district or operated by or on behalf of any school district in this state shall have seat backs which extend at least twenty-eight inches from the bottom to the top of such backs and shall also be equipped with a sufficient number of safety belts to accommodate the driver and each passenger on the school bus.

2. In any action against a school district, a school bus operator under contract with a school district, or any agent or employee of such district or operator, in which the cause of action arises out of an accident involving the operation of a school bus, no evidence shall be offered relative to whether or not safety belts were used by the driver or any passenger on the school bus at the time of the accident.

3. As used in this section, the term "school bus" shall have the same meaning given it in section 301.010, RSMo.
