This substitute disallows any assessment for public improvement entered as a lien against any agricultural or horticultural property. Assessments for public improvement may be entered as a lien if the property is no longer assessed as agricultural or horticultural property or if the property was not in agricultural or horticultural production for 3 out of 5 consecutive years. The provisions of the substitute do not affect any assessment in existence on the effective date of the substitute. FISCAL NOTE: No impact on state funds. PROPONENTS: Supporters say that public improvements not benefitting agricultural or horticultural property should not be paid for until the improvements benefit the property. HB 1683 -- Agricultural or Horticultural Property Sponsor: Leake This bill disallows any assessment for public improvement entered as lien against any agricultural or horticultural property. Assessments for public improvement may be enter as a lien if the property is transferred to a person not within the third degree of consanguinity or affinity, if the property is no longer assessed as agricultural or horticultural property, or if the property was not in agricultural or horticultural production for 3 out of 5 consecutive years.
